1. Agreement to Terms

By accessing or using InstaBiz ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

InstaBiz provides website design and hosting services for local businesses. Our service includes:

  • Custom website design and development
  • Website hosting and maintenance
  • Ongoing content updates upon request
  • SSL certificate and domain configuration support

3. Subscription & Pricing

  • The Service is billed at $99 per month with no upfront cost
  • Billing begins once your website goes live
  • You may cancel your subscription at any time — no long-term contracts
  • Upon cancellation, your website will remain active through the end of the current billing period
  • We reserve the right to change pricing with 30 days' notice

4. Your Responsibilities

As a user of InstaBiz, you agree to:

  • Provide accurate business information
  • Maintain the security of your account credentials
  • Not use the Service for any unlawful purpose
  • Not upload content that infringes on intellectual property rights
  • Respond to communications regarding your website in a timely manner

5. Intellectual Property

  • You retain ownership of all content you provide (text, images, logos)
  • InstaBiz retains ownership of the website design templates and underlying code
  • You are granted a non-exclusive license to use the website design while your subscription is active
  • The InstaBiz brand, logo, and platform design are our intellectual property

6. Website Delivery

  • We aim to deliver your initial website within 3 business days of receiving your information
  • Delivery timelines are estimates and not guarantees
  • Revision requests are included in your subscription
  • Major redesigns may require additional time

7. Limitation of Liability

InstaBiz is provided "as is" without warranties of any kind. We are not liable for:

  • Temporary service interruptions or downtime
  • Loss of business or revenue resulting from website issues
  • Third-party service outages (hosting, DNS, payment processors)
  • Any indirect, incidental, or consequential damages

Our total liability shall not exceed the amount you paid for the Service in the 3 months preceding the claim.

8. Termination

We reserve the right to suspend or terminate your account if you:

  • Violate these Terms of Service
  • Fail to make payment after reasonable notice
  • Use the Service for illegal or harmful activities

9. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will notify you of significant changes via email.

10. Governing Law

These Terms are governed by the laws of the State of Florida, United States. Any disputes shall be resolved in the courts of Sarasota County, Florida.
